Terms of Sale

These terms govern purchases of farm products from EcoSky Farms LLC, a Colorado limited liability company (entity no. 20241755654). The seller is EcoSky Farms LLC. The principal farm office is 9880 Hillside Drive, Forestville, CA 95436, United States.

Products

We sell agricultural products: seasonal vegetables, culinary herbs, eggs when available, and CSA shares. Descriptions on this site are typical, not a guarantee of a specific cultivar on a given week.

Orders and payment

An order is accepted when the farm confirms it. Prices are in US dollars. Card payments, when enabled, are charged by EcoSky Farms LLC (or its payment processor acting for the farm). Until card checkout is live, confirmed pickup orders may be paid as the farm office instructs at pickup.

Pickup, not shipping

Default fulfillment is customer pickup in Forestville, California. We do not offer nationwide parcel shipping of perishable produce. Risk of loss passes when you collect the goods, or when we set them out for an agreed pickup window that you miss.

CSA

A CSA share is a prepayment for a season of harvest. Contents vary. Skips are limited as described on the CSA page. Unused weeks at the end of the season are not automatically cashed out except as required by the refund policy or by a farm decision if we cancel the rest of the season.

Allergens and food

Produce may be grown near other crops. Eggs are a common allergen. We are a small farm, not a packaged-food factory. If you have a medical dietary restriction, ask before you buy.

Limitation

To the extent allowed by California and Colorado law, EcoSky Farms LLC is not liable for indirect or consequential damages. Nothing here limits liability that cannot be limited by law, including for personal injury caused by our negligence.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except that internal LLC affairs remain subject to Colorado law. Venue for disputes related to a sale is Sonoma County, California, unless a consumer-protection statute requires otherwise.
